ACCEPTANCE OF TERMS

These Terms & Conditions govern access to and use of the ZIZOU DESIGN website and the digital products made available through it.

ZIZOU DESIGN is the brand under which this website and its products are offered. References to “ZIZOU DESIGN,” “we,” “us,” or “our” refer to the owner and operator of the ZIZOU DESIGN brand and website.

By using the website, purchasing a product, or using a purchased product, you agree to these Terms & Conditions and the related policies that apply to your use or purchase.

You must have the legal capacity to enter into a binding agreement or any authorization required by applicable law.

DIGITAL PRODUCTS

ZIZOU DESIGN offers original digital creative works, including photography, digital art photography, designs, and other digital artwork.

Unless expressly stated otherwise in a product listing, products are delivered digitally. No physical artwork, print, frame, or other physical item will be shipped.

Each product listing describes the material characteristics of the product offered, including its applicable file format, specifications, price, and included content. Customers are responsible for reviewing this information before purchasing.

Products, prices, previews, and availability may change before a purchase is completed. Such changes do not retroactively alter rights already granted under a completed purchase except where required by law or expressly agreed.

ORDERS, PAYMENT & MERCHANT OF RECORD

Purchases made through the checkout available on this website are processed by Lemon Squeezy, which acts as the Merchant of Record and authorized reseller for those transactions.

The customer purchases through Lemon Squeezy while the underlying ZIZOU DESIGN digital product is supplied and licensed by ZIZOU DESIGN.

Lemon Squeezy handles transaction functions associated with its Merchant of Record role, including payment processing, applicable sales tax, VAT or similar indirect taxes, refunds, chargebacks, and related payment compliance.

Customers must provide accurate and current information during checkout. Orders are subject to successful payment processing and transaction confirmation.

A transaction may be declined, cancelled, or corrected where necessary because of payment failure, suspected fraud, a material pricing or technical error, legal requirements, or action taken by the transaction provider.

Transactions processed through Lemon Squeezy are also subject to the Lemon Squeezy Buyer Terms .

DIGITAL DELIVERY

Purchased products are delivered electronically through the method associated with the transaction, which may include email, an order confirmation, receipt, customer portal, or download page.

Customers are responsible for maintaining access to the email address, device, software, internet connection, and other technology reasonably necessary to receive and use purchased files.

Genuine delivery problems, corrupted or inaccessible files, and remedies relating to digital delivery are addressed in the ZIZOU DESIGN Refund Policy .

INTELLECTUAL PROPERTY & DIGITAL LICENSE

All original artwork, photography, designs, website imagery, written creative material, and other original creative works offered under the ZIZOU DESIGN brand are created and owned by the owner of ZIZOU DESIGN and are protected by applicable intellectual property laws.

Purchasing or accessing a digital product does not transfer ownership, copyright, or other intellectual property rights in the underlying work. A purchaser receives only the limited rights granted with the purchased product.

The specific rights granted to purchasers and restrictions concerning personal use, printing, reproduction, sharing, modification, redistribution, commercial use, and other uses of purchased artwork are governed by the ZIZOU DESIGN Digital License .

REFUNDS

Because ZIZOU DESIGN products are digital and may be made available immediately after purchase, sales are generally final once a product has been delivered or made available for download.

Refund eligibility, technical file problems, duplicate or incorrect charges, applicable exceptions, and other refund-related matters are governed by the ZIZOU DESIGN Refund Policy , applicable law, and Lemon Squeezy's applicable responsibilities as Merchant of Record.

PRIVACY

Personal information may be processed in connection with purchases, customer support, communications, website functionality, security, and other legitimate business or legal purposes.

Information about the personal information that may be handled, how it is used, service providers, cookies or similar technologies, retention, security, and applicable privacy rights is provided in the ZIZOU DESIGN Privacy Policy .

WEBSITE USE & RESTRICTIONS

The website may be used only for lawful purposes and in a manner that does not interfere with its operation, security, or the rights of ZIZOU DESIGN or others.

You may not attempt unauthorized access, introduce malicious code, interfere with website security, engage in fraudulent activity, or obtain restricted information without authorization.

Automated scraping, systematic extraction, or unauthorized automated collection of protected ZIZOU DESIGN content is prohibited to the extent permitted by applicable law.

Digital artwork may appear differently across displays, devices, software, printers, papers, and printing methods because of differences in calibration, color reproduction, settings, processes, and materials.

To the maximum extent permitted by applicable law, ZIZOU DESIGN will not be liable for indirect, incidental, special, or consequential losses arising from use of, or inability to use, the website or a digital product.

To the extent permitted by applicable law, aggregate liability arising directly from a purchased product will not exceed the amount paid for the product giving rise to the claim.

Nothing in these Terms & Conditions excludes, restricts, or waives any liability, warranty, consumer protection, or other right or remedy that cannot lawfully be excluded, restricted, or waived.

RELATED POLICIES & PRIORITY

These Terms & Conditions should be read together with the applicable product listing, the ZIZOU DESIGN Digital License , the ZIZOU DESIGN Refund Policy , and the ZIZOU DESIGN Privacy Policy .

The Digital License governs permitted and prohibited use of purchased artwork. The Refund Policy governs ZIZOU DESIGN's refund practices. The Privacy Policy governs ZIZOU DESIGN's handling of personal information.

Matters for which Lemon Squeezy acts as Merchant of Record are also subject to Lemon Squeezy's applicable terms, policies, and responsibilities.

APPLICABLE LAW & CONSUMER RIGHTS

These Terms & Conditions operate subject to applicable law. Nothing in these Terms is intended to exclude, restrict, or waive a mandatory right or protection that cannot legally be excluded, restricted, or waived.

Where a mandatory consumer law applies to a transaction and conflicts with these Terms, that law will apply to the extent required.

GENERAL TERMS

These Terms & Conditions, together with the policies and product terms incorporated into them, constitute the agreement governing the matters they address.

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

A failure by ZIZOU DESIGN to enforce a provision does not waive the right to enforce that provision later.

CHANGES & CONTACT

ZIZOU DESIGN may update these Terms & Conditions to reflect changes to products, website functionality, business practices, service providers, or legal requirements.
